Norvell responds to ABC's Good Morning America story on spray tanning

AN OPEN LETTER TO NORVELL COLLEAGUES AND ASSOCIATES



The anticipated ABC story on spray tanning safety has now been aired. I expect there will be many thoughtful responses to the story from the spray tanning industry and the cosmetics industry in the coming days correcting the many errors in the report and providing incontrovertible evidence of the safety of spray tanning. For the present, however, I would like to give you a brief overview of the information now available.



Perhaps the best place to start is the open letter which Norvell distributed on May 29, 2012, providing a summary of the situation as it existed at that time. You may have received a copy. If not, you may view the letter online http://www.norvelltanning.com/2012DHAFDALetter.html.



Moving on to the ABC report, the reporter relied heavily on a 2006 FDA Product Information Publication. The FDA Publication, while helpful, and which I recommend you read (it can be viewed online at http://www.fda.gov/Cosmetics/ProductandIngredientSafety/ProductInformation/ucm134064.htm) is wildly misconstrued and misrepresented by the reporter. In reviewing the Publication you should keep in mind the following:



• The FDA Publication is not a finding that DHA and spray tanning are harmful. It points out that DHA, the ingredient in question, has long been accepted for topical application. It is recommended users should take care to protect the eyes, the nose and lips. This approach has been embraced by Norvell. We provide products for customers to protect the potentially affected areas and encourage everyone to follow the recommendations. The important thing is that, contrary to the impression presented by the ABC reporter, the FDA has not found DHA used in spray tanning to be harmful.



• The FDA Publication is not the most current information on this subject. A more comprehensive report published December 14, 2010, by the European Commission Scientific Committee on Consumer Safety is available online at http://ec.europa.eu/health/scientific_committees/consumer_safety/docs/sccs_o_048.pdf. While the study is lengthy, and should be reviewed in its entirety, I recommend that you at least take a look at the study’s conclusions on page 32. In summary, the report says that based upon the available information, the Scientific Committee on Consumer Safety considers that the use of DHA as a self-tanning agent in spray tanning up to a 14% concentration will not pose a risk to the health of the consumer. All Norvell spray products are at a concentration significantly less than 14%.



• The reporter chose to acknowledge, but then ignore, a detailed letter sent to the reporter by Merck Pharmaceuticals pointing out the errors in one of the reporter’s key studies used in his report to reference the potential negative effects of DHA on DNA . I invite you to read the Merck Pharmaceuticals response, a copy of which is attached. Clearly, the reporter only wanted information which slanted the story in the direction he wanted to go.

While we are on the subject of the reporter’s point of view, I want to point out that the central issue is, and remains, consumer safety, and I have no doubt that ABC, and the reporter, are genuinely concerned about consumer safety. I think it is unfortunate, however, that the way this particular story was put together indicates that the reporter, while interested in safety, was more interested in sensationalism. For example, I invite you to view industry spokesman Joe Levy’s YouTube presentation at http://www.youtube.com/watch?v=zrT2eIzjoME. Joe explains the way in which his interview with the reporter was staged and then edited. Instead of being a good faith effort to obtain information on this subject, the interview turned out to be an “ambush” with the apparent goal being to present as sensational and unflattering a view of the sunless tanning industry as possible, no matter what the actual facts might be.



It is also noteworthy that the reporter chose to make no reference in the report to any of the major cosmetic companies, such as Neutrogena, Clinique, Banana Boat and many others, who have been selling aerosol cans of spray tanning products with DHA for years. These products are indistinguishable from the spray tanning industry products, yet not one word about those products. I am happy for those companies since, their products, like our products, are safe. I am curious though, why, if the reporter truly believes our products are unsafe, he gave a pass to the major cosmetic companies. At the risk of appearing cynical, I can’t help but think it may have been because it is much harder to ambush multi-million dollar advertisers on your network.



In summary, sunless spray tanning is safe. The best available research supports this conclusion. The ABC report is an aberration which is unfair to our industry and which will have no lasting effect.

Joe Levy of Smart Tan gives background on ABC's GMA spray tanning story

Hollywood Tans Atlanta comments on Self Tanning | 11 Alive News


Kelly, the manager of the Hollywood Tans in Sandy Springs, does an excellent job of demonstrating a UV-free Mystic Tan, and also comments on safety conerns of DHA, the active ingrediant in self tanner, as well as the FDA's advisories regarding self tanner and Hollywood Tans products available to protect consumers from inhaling self tanner. 11 Alive news reporter Duffy Dixon interviews Kelly, as well as an unnamed doctor who cites a mysterious study allegedly shows a link between usage of DHA and alterations of animals DNA. The doctor does not give the source or date of the study, however after scaring viewers with allegations of DNA alterations, she does conclude that it's "... in the right settings it's probably OK to continue your spray tans." Hollywood Tans however supplied 11 Alive with this study, done by the European Commission in 2010, which concluded after extensive study that "the use of Dihydroxyacetone (DHA) as a self-tanning ingredient in spray cabins... will not pose a risk to the health of the consumer."

Dr. Oz Endorses Sunbeds

Television health guru Dr. Mehmet Oz — better known as “Dr. Oz” — said on his program this week he is re-thinking his position on indoor tanning sunbeds because they are an abundant source of natural vitamin D production as well as other compounds made in the skin.



“The sun provides vitamin D in a very unique way. But it also provides tons of other compounds besides vitamin D.” Oz said in an interview on his own program with health educator Dr. Joseph Mercola. “I am rethinking tanning beds. In the last year I have looked at a lot of information. …I think there is a value of UVB radiation, not just for vitamin D but for other sources as well.”



Oz was commenting on Mercola’s recommendation that use of sunbeds in the winter is a key to good health. Mercola is among those who believe humans need 8,000 IU of vitamin D daily to assure that vitamin D blood levels are in natural range consistent with outdoor living and at levels indicated by hundreds of studies to be associated with lower risk of health problems from cancer to heart disease and autoimmune disorders.



No food source comes close to delivering that level of vitamin D. UVB from sun exposure can make up to 20,000 IU of vitamin D in the skin without the risk of an overdose, as the skin naturally de-metabolizes any extra vitamin D.



When Mercola told Oz that he recommends sunbed usage in the winter Oz’s in-studio crowd reacted in shock.



The two health education icons — in endorsing sunbed usage to make vitamin D — showed that they still do not fully understand all of the photobiology of tanning equipment. Oz suggested that most sunbeds emit UVA but not UVB — and that consumers need to look for equipment that emits measurable UVB.



“Dermatology has been misleading Oz,” Smart Tan Vice President Joseph Levy said. “More than 90 percent of sunbeds today emit UVB and UVA in dosages consistent with natural sunlight. But we’re glad that he seems to be open to the fact that there is a natural benefit to UV from sunlight, and that sunbeds can be a good surrogate for that.”



Oz still says he does not recommend sunbed usage for tanning — just for vitamin D production. “Again, that’s not a straight distinction,” Levy said. “Tanning has nothing to do with vitamin D production — melanin production happens while vitamin D is being produced. They happen at the same time.”



Mercola also continues to make issue of magnetic ballasts used in some sunbeds, alleging that electromagnetic fields (EMF) are dangerous. But EMF levels generated by sunbeds expose users to less EMF than cell phone usage — very small dosages one would find in many electronic products. Sunbed industry representatives have asked Mercola to document the source of his allegation about ballasts but have never received an answer.



Mercola and Oz also refer to what they called “safe” tanning beds — those that emit UVB and which use electronic ballasts instead of magnetic ballasts. Mercola sells equipment with electronic ballasts through his web site.

The magazine that has sold millions of dollars in chemical sunscreen advertising in exchange for leading a public relations charge to restrict teenagers from tanning salons has now been targeted by thousands of angry consumers who want to ban its teen-inappropriate covers from grocery store racks.



Fox News reported this week that Cosmopolitan Magazine is the target of a petition and a Federal Trade Commission complaint alleging that the magazine’s cover material — which frequently includes racy pictures of teen-age girls — is inappropriate for young eyes in grocery store check-out lines.



“Cosmopolitan magazine released its February issue this week featuring 17-year-old Dakota Fanning as the cover girl, surrounded by article captions such as ‘His Best Sex Ever,’ ‘Too Naughty To Stay Here: But You Have to Try This Sex Trick,’ Fox reported.



According to Fox, a petition with more than 10,000 signatures asking that Cosmo be treated like an X-rated magazine — with its cover hidden by a wrap when sold at newsstands — has already turned heads. And the petition’s founder, Nicole Weider, has contacted the Federal Trade Commission to get help on filing an effective complaint.



“As a former reader of the magazine, I happened to pick up an issue and was reading it and was completely shocked at how pornographic and explicit the content had become. I immediately thought of my young teenage brothers and it horrified me to think that they and their friends could be reading this material, and the damage it would do to them if they did,” Weider told FOX. “So I decided to do something about it.”
